Cancellation Policy

We may at our option cancel your reservation via email if:

• The information you provide as a part of the application and reservation process turns out to be false; and/or
• You fail to meet student status requirement; and/or
• You fail to sign the Residential Tenancy Agreement/License to Occupy when required; and/or
• You fail to pay the Advance Deposit/Reservations Fee; and/or
• You fail to pay the Bond/ Security Deposit by the specified due dates.

Please be advised that upon making the initial deposit payment, you are required to sign the Lease Agreement/License to Occupy/Occupancy Agreement and submit the Bond/Security Deposit payment within one week. Y Suites reserves the right to cancel your booking and forfeit your deposit payment should you fail to comply with this requirement.

Cancellations Prior to Lease Commencement

No Offer No Pay

If before 7 days of commencement of lease agreement:

• You received confirmation that you are not accepted from any institution in the city of the property booked (Y Suites on A’Beckett (MEL), Gibbons (SYD), Regent (SYD) and Moore (CBR) and

• Within 24 hours of receiving university’s non-acceptance confirmation, you are required to send a written email requesting for cancellation to
reservations@ysuites.co with the following information:

1. Reservation Number & Property booked: Y Suites on A’Beckett, Gibbons, Regent and Moore

2. Proof of rejection letter/confirmation from the institution under the relevant cities.

No Visa No Pay

If before 7 days of commencement of lease agreement:

• You are refused a visa to study in Australia by Department of Home Affairs (DHA) and
• Within 24 hours of receiving DHA refusal, you are required to send a written email requesting for cancellation to reservations@ysuites.co with the following information:

1. Reservation Number & Property booked: Y Suites on A’Beckett, Gibbons, Regent and Moore

2. Proof of DHA refusal letter/confirmation.

If before 7 days of commencement of lease agreement:

• Your Visa is still on Pending/Processing stage, you are required to send a written email requesting for cancellation to reservations@ysuites.co with the following
information:

1. Reservation Number & Property booked: Y Suites on A’Beckett, Gibbons, Regent and Moore

2. Proof of Pending/Processing stage screenshot from DHA website.

Terms & Conditions:

• After all the information is well-received and verified, you will then be formally advised that your lease agreement cancelled without penalty and will be guided on refund process.

• If this information is received after the specified timeframe, you will not be eligible for the refund policy and will follow our Standard Cancellation Policy.

• This policy is only applicable to our Melbourne, Sydney and Canberra properties

Selected Room Type Is Unavailable

Y Suites may also provide the flexibility to refund the Payable Deposit if the reservation is cancelled by us if the selected room type is unavailable.

For all other reasons for cancellation of reservation

• The Advance Deposit, including the AU$55.00 fee for the Shower Curtain and Mattress Protector, will be retained as it is non-refundable.
• If your reservation is for Y Suites on Gibbons, the Payable Deposit will be retained as it is non-refundable.

Cancellations After Lease Commencement

You will be required to sign a Residential Tenancy Agreement, Rooming House Agreement, License to Occupy prior to arrival. Once the Residential Tenancy Agreement, Rooming House Agreement or License to Occupy is signed, the terms and conditions of the Tenancy Agreement, Rooming House Agreement or License to Occupy will then apply and supersede any other conditions of cancellation policy.

The Residential Tenancy Agreement, Rooming House Agreement or License to Occupy is a legally binding document, which if broken will incur penalties. Where a resident believes they cannot stay in the room or continue to pay the Rent/Occupancy Fee, they must notify Y Suites management in writing and complete a lease break form as soon as possible.

When considering prematurely terminating your Residential Tenancy Agreement, Rooming House Agreement, it is your responsibility to do the following:

• Continue to pay the rental payments for the remainder of the agreement or until the apartment is re-let plus a portion of the letting fee and advertisement fee (if you have nominated Y Suites to advertise for you, calculated according to the Residential Tenancies Tribunal formula).
• You may help in finding another suitable person, who needs to apply to Y Suites and have his or her application accepted by management, to take over your apartment.
• A departure cleaning fee may apply if the apartment is not returned in the same or better condition to the owner.

When considering prematurely terminating your License to Occupy, it is your responsibility to do the following:

• You will be charged an early termination fee of two (2) weeks’ occupancy fee if the License to Occupy is ended by you within the first 48 weeks of the commencement of the License to Occupy
• You will continue to pay all occupancy fees and charges as set out in Clause 3 of your License to Occupy until such time as an approved new Resident commences a contract for a period no less than the current agreement.
• Additional cleaning fees may apply if the room is not returned in the same condition, allowing for fair wear and tear.

When considering prematurely terminating your Occupancy Agreement, it is your responsibility to do the following:

• You will be charged an early termination fee of two (2) weeks’ rent.
• You will be liable to pay the rent until the earlier of:
— the end date of your Occupancy Agreement; or
— the date that Y Suites enters into a replacement Occupancy Agreement for the Bedroom,
• You will be liable to pay Y Suites the equivalent value of incentives that were accorded to you as part of your Occupancy Agreement.
• Additional cleaning fees may apply if the room is not returned in the same condition, allowing for fair wear and tear.

Note: *The Cancellation Policy is only available to new students with a booking, who have not previously stayed with us. Please note that once your contract commences, this policy no longer applies.
